PART 1 - INSTRUCTION TO WORK
1. Stator Facilities Solutions Ltd requires an ‘instruction to carry out work’ notice for all types of work, either in written or verbal format.
- Any work to be carried out within 7 days of the acceptance of the contract will require a written & signed instruction before any work begins. (Domestic customers only).
- Stator Facilities Solutions Ltd can provide you with an acceptance of contract notice template, or a cancellation of contract template should you wish to use it. You may however use your own or confirm in writing.
- An acceptance of contract will be based on the proposed schedule of works submitted, agreed by both parties. 4. You, as the client may cancel the contract should you so choose to with Stator Facilities Solutions Ltd. Such cancellation will require a written notice by you.
- The cancellation notice will only become effective upon receipt by Stator Facilities Solutions Ltd. Once received we will contact you to discuss the closure of your account.
- Stator Facilities Solutions Ltd may charge you, after the receipt of the cancellation notice for any charges incurred as a result of the cancellation, for any un-billed labour, materials used and any outstanding accounts not yet settled.
- Stator Facilities Solutions Ltd will always work with you, the client in such circumstances where it is deemed necessary to close a contract, cancel or temporarily halt a contract of work. We will always ensure that you are informed of the proposed closure of work procedure, ensure all work safely comes to a stop, all ur materials, tools etc are removed and the site left in a reasonable condition.
- Stator Facilities Solutions Ltd will expect you, the client to be fully co-operative in such an event, including full payment of the final invoice submitted.
PART 2 - TERMS AND CONDITIONS OF CONTRACT.
1. Stator Facilities Solutions Ltd operates during normal working hours between 9am & 5pm Monday to Friday, unless otherwise stated or requested.
1. Stator Facilities Solutions Ltd is able to provide a service outside normal working hours, on the condition that our terms and conditions proposed in the schedule of works are accepted.
2. Outside normal working hours will be charged as per follows, unless otherwise stated:
1. 5pm (17:00) till 8am (08:00) Monday to Friday at time plus half (1 ½)
2. Saturday 24 hours at double time (2)
3. Sunday 24 hours at double time (2)
3. All visits where an engineer representing Stator Facilities Solutions Ltd is required to carry out installation, testing, fault finding or investigation work (unless the service is free) are subject to our initial charge fees at £110 +VAT within our local postal code areas and in our normal working hours.
4. All visits outside our local postal code areas are subject to travel time, mileage plus the initial charge fee.
5. Stator Facilities Solutions Ltd do not as a matter of policy carry out any plastering, patching or re decoration works due to the works being carried out, unless otherwise stated in the schedule of works or variation contract. The client/main contractor/project manager is responsible for ensuring that the required trades are available upon our completion to carry out these works where needed.
PART 3 - VARIATION CONTRACT
1. Any changes made to the original proposed schedule of works are subject to a variation contract.
1. A variation contract is a notice of ‘acceptance of variation’ submitted by either party, written and signed by both parties.
1. You will receive the original copy of the variation contract once signed.
2. A change to the proposed schedule of works may occur in the following circumstances:
1. Any exposed faults found during the course of other works arising from adverse building construction that could not reasonably have been foreseen.
2. During remedial works after an Electrical Installation Condition Report, or other inspection and test. NOTE: An inspection and test or EICR only samples a percentage selection of the electrical installation. Any concealed wiring, accessories or areas of inaccessibility are such places of a fault being exposed during remedial works.
3. This list is by no means exhaustive. More details can be requested from Stator Facilities Solutions Ltd.
3. Stator Facilities Solutions Ltd will charge accordingly for any variation, or change from the original schedule of works, such as:
1. Any additional visits required as the result of any variation of contract, agreed or not.
2. Waiting time and/or an additional visit where access is not available at the agreed appointment.
3. At the discretion of Stator Facilities Solutions Ltd, abortive visits (where the engineer turns up to the site as agreed but is unable to access the site or is no longer required to complete the agreed work) and there is no proof of prior cancellation with at least 24 hours’ notice. A minimum abortive visit fee of £110+VAT will be applied with a maximum abortive visit fee equal to the full labour charge for the project.
4. Changes made to the original schedule of works, agreed or not.
4. Stator Facilities Solutions Ltd will always aim to provide you, the client with a written variation contract that includes the total price for the stated variation of contract.
1. It is not always reasonably practicable to provide a total price for any variation of contract. Therefore, Stator Facilities Solutions Ltd shall provide an estimate only based price.
5. All variations, changes to the schedule of works or cancellation of part or the entire contract should be notified at the earliest possible time to minimise disruption and escalating costs.
6. Should a variation to the agreed proposed schedule of work arise without the person ordering the work present, Stator Facilities Solutions Ltd will continue with what action is necessary, deemed to make that part of the installation safe, user friendly or convenient for a later time. We shall aim to contact you, the client in the meantime to resolve the situation as quickly as possible.
